Justice is an Illusion

About a week ago I wrote an entry highly critical of the Canadian justice system in general and Judge Lismer in particular. In case you didn’t see that post here is a brief recap.
In July 2005 Winnipgger Christopher Irvine was involved in three robberies. In the first instance he pulled a knife on the female employee of a boutique demanding cash. He then forced the woman into a backroom and rubbed her vagina while holding the blade to her face. A few days later he robbed a beauty salon making off with a substantial amount of cash from the female employee. Then in late July he confronted yet another woman this time in a flower shop. He was chased off by several male customers who eventually caught up with him holding him for police. For his efforts he was handed a 30-month prison sentence but because of a precedent setting ruling by Judge Lismer which states that an accused criminal who is released into the community on bail should be given credit toward their overall sentence upon conviction he won’t see a day in jail.
Now we have yet another outrageous miscarriage of justice. Clara Da Silva, 27, left her 2-year-old daughter to fend for herself for 33 hours in sweltering heat while she spent the night bar-hopping. As a result young Adrianna succumbed to the effects of dehydration. Da Silva was sentenced to three years but having already served two of them she qualifies for statutory release. Nice. An innocent 2-year-old child is dead and the mother is out in two. Is that what a human life is worth?
