Copyright Infringement?
From the The Star,
The Canadian Broadcasting Corporation has come out slugging over a “Hockey Fight in Canada” website.
The public network has served a one-man B.C.-based website with a cease and desist order, calling on www.hockeyfightincanada.com to stop using the Hockey Night In Canada takeoff logos and name on its site, caps and T-shirts.
As much as I hate to admit this because I think the web site is a cool idea the CBC may have a case. If you look closely at both logos while not identical it is obvious one is a direct take-off of the other. Having said that the demands of the CBC have gone a bit too far. While the logo may indeed be a possible copyright infringement I see no reason why the owner should have to shut down his site and surrender the domain name.
A letter sent on March 12 to Mills’ LocoBoy Clothing Co. calls for him to stop using the hockey fight logo, shut down the website and surrender the domain name to the CBC.
A redesign of the logo should be sufficient. If the CBC wants the domain name then they should enter into negotiations with the proprietor for its purchase.
