Smoking on/in private property

Regarding the National Post’s position of opposing the Ontario Medical Association’s recommendation to ban smoking in private vehicles that are used to transport children, Michael of Living in Unmentionable Times writes in his letter to the editor,
Dear Editor,You correctly assert that the OMA’s recommendation to ban smoking in private vehicles, if realized, would constitute an unwelcome infringement on property rights. However, stating that this would “set us down the slippery slope of regulating behaviour on private property” omits the fact that we are already sliding down such a slope. Workplaces, bars and restaurants are private property too. Government induced smoking bans in such places are already in effect hence the precedent for infringing on property rights in the name of health has already been set. It will be difficult to oppose a ban on smoking in cars on the basis of private property rights when we have already accepted the legal precept behind such a ban.”
